Modified Application to be Filed with Anti-Trust Authority Regarding Tencel Acquisition

With its decision of 14 February 2005 the Austrian Supreme Court confirmed the decision of the anti-trust authority of 28 October 2004 which restrained Lenzing from acquiring Tencel.
While the case was pending with the Austrian Supreme Court, Lenzing already reached an agreement with the anti-trust authorities on the conditions and limitations that will address the concerns.
A new application concerning the Tencel acquisition incorporating the quite extensive modifications will be filed in the next few days. Since agreement has been reached on the terms, a swift approval of the merger is expected.

The supervisory board of Lenzing AG today announced that they will propose Peter Untersperger as their new chairman as of 1 January 2009 to the company's management board. Peter Untersperger currently is head of finance and will succeed Thomas Fahnemann, who is to join RHI AG.
